why is the iOS 4.0.1 sdk apple confidential

i was going through the downloads on the site looking for ios sdk that included ipad simulator with firmware 3.2 and i found ios 4.0.1 sdk but it had this warning on it

" Pre-release software, including information about pre-release software, is Apple Confidential Information and is subject to the terms of your Apple Developer Program License Agreement, and/or Registered Apple Developer Agreement, as applicable. Unauthorized distribution or disclosure of Apple Confidential Information is prohibited."

is this still valid (even though the sdk is probably no longer supported) or did they forget to remove this warning

oh and does anyone have the iphone sdk 3.2? i cant find it anywhere

I believe in the case of both beta and release SDKs, the confidentiality clause is due to devs/beta participants not being authorized to re-distribute either in what would be an uncontrolled manner.

See your dev/beta agreement for details.

BTW, I don't believe simulators include firmware.
