Is there a shake gesture available for the Apple TV remote? how is this accessed?

There doesn't seem to be a built-in way to do this (the property used to enable it is missing from tvOS's UIApplication), but you can always do it the old-school iOS 2 way, by reading the accelerometer yourself and detecting a shake.
