[102963199538] P2B Regulation compliant: statement of reason requested, TOTALGYMACCESS LIMITED

Formal Complaint and Request for Statement of Reasons

Regulation (EU) 2019/1150 (Platform-to-Business Regulation)

Date: 2 November 2026

Entity: TOTALGYMACCESS LIMITED

Application submitted: 10 August 2026

To: Apple Developer Support and Compliance Legal Team

Apple Developer Support case ID: 102963199538

Apple privacy case ID: 22855378

Enrollment ID (as shown in the Apple Developer app): 7L6W667C4M

Subject: Declined company enrollment, Apple Developer Program

  1. Complaint

I am writing on behalf of TOTALGYMACCESS LIMITED to make a formal complaint about Apple’s decision to decline our company enrollment in the Apple Developer Program, and to request a written statement of reasons for that decision.

  1. Background

TOTALGYMACCESS LIMITED submitted its company enrollment in the Apple Developer Program on 10 August 2026. Apple declined it on 21 September 2026 and has not told us why. We contacted Apple Developer Support by email on 14 September, 28 September, 3 October, 18 October and 31 October 2026 asking for the reason and for a review. We have still not been given any explanation. Apple’s case record for support case 102963199538 shows the case as closed, with its last update on 15 October 2026.

Although the enrollment was declined, its status in the Apple Developer app still shows as “In Review” (enrollment ID 7L6W667C4M), while the Apple Developer website shows it as declined. We believe this stuck status is preventing us from submitting a new application, so we cannot correct whatever the problem was and try again.

  1. Why this matters

TOTALGYMACCESS LIMITED operates a gym subscription service for consumers in the EU, and our app is ready for release. Without a developer account we cannot distribute it on the App Store. We understand that the App Store is an online intermediation service covered by the P2B Regulation, and that providers of such services are required to explain decisions that restrict a business user’s access and to operate an internal complaint-handling system. We ask that this letter be treated as a complaint under that system.

  1. What we are asking for

  2. A clear, specific statement of reasons: the facts and circumstances that led to the decision to decline our enrollment.

  3. A human review of that decision by someone who was not involved in the original decision, with the outcome given to us in writing. Please also confirm whether the decision was made solely by automated means.

  4. Confirmation of the current status of every enrollment linked to our company and to my Apple Account, including an explanation of why the Apple Developer app shows “In Review”.

  5. Closure or removal of the pending “In Review” enrollment record, so that we are able to submit a new application.

  6. Details of any information or documents we can provide to resolve the matter, and how we can reapply.

  7. A written response within 14 days of the date of this letter.

  8. Next steps

If we do not receive a substantive response, we intend to refer the matter to the Competition and Consumer Protection Commission, the competent authority for the P2B Regulation in Ireland, to use the mediation options available under the Regulation, and to raise the matter with the Data Protection Commission in connection with our data access request (case 22855378).

We would much prefer to resolve this directly and would welcome the chance to do so.

Yours sincerely,

Mike Rainsford
