When I first submitted my app I mistakenly answered NO to the question

Does your app contain third party content.?

I should have answered YES

When I resubmit a new build the question 'contains third party content' does not appear

Can anyone help

IIRC, that comes up when you submit for review, so when you say 'resubmit a new build', do you mean upload a new build, or you're past that and already flagged it for review?
