Filling U.S tax form (W8BEN iTunes Connect) as a solo developer who doesn't want to use tax treaty?

Hi, I'm not a U.S citizen and I'm a solo developer (not a company) working outside of U.S, I wanna pay the 30% tax to apple and not using tax treaty and dont want to have the "twice tax payment issue". I have filled sections 1,2,3,4,8 with my name and address and date of birth etc.. but!

1. Can I leave Part II and Part III empty since i'm not using any tax treaty?

2. How can I avoid twice tax issue that some people have mentioed?

3. Do i have to fill the section 6? (even though im a solo developer?) and if so, should i use the " 9 zero (000000000)" in section 6? i dont understand what is it for.

4. what should i type in "Capacity in which acting"? some people say "individual" some people say "self".

If you expect to be paid, you MUST fill in all of the contracts and forms fully.

You are responsible for paying taxes in your country for all monies earn

by your apps in the app store. The 30% by the way, is not a tax payment it is

Apple's fee for hosting your apps and making them available globally. It also

covers their processing fees for payments and so on.

So in order to complete the form without using tax treaty, what should i put in section 6? because "9 zero (000000000)" is for the countries which do have tax treaty with usa and for the companies, now im a solo (indie) developer, not a company, what should i put there? and also in this field >> "Capacity in which acting" what should i put there? and if the 30% cut isnt related to tax, how many percentace of tax does apple take from the countries which dont have tax treaty with U.S? i mean will it be like 30% Cut for apple + X% tax but how much the tax would be usually?(i know the taxt would be different for different countried but still) I really need to fill it as fast as possible. thank you for helping me.

I understand, I just want to know three things that is not only valid for my situation, but its essential for every developer. I want to know, how much total revenue will be cutten from my total revenue? 30%(Taken by Apple) + X% (Tax which varies between different countries), I understand that but what is the range for X% tax? some people are saying that they have two 30% (which means 30% for apple and 30% tax !). So my first question is that how can i prevent this from happening and my two other questions are about section 6 and "Capacity in which acting" parts, but ill try to contact them.

From what I understand, filing form W-8BEN is used to avoid a statutory 30% foreign-person witholding rate when not filed. This is likely what "some people" said somewhere. You would have to ask them.


Really, it sounds like you need advice from a tax professional in your country. I would not rely on random information online or other developers in this forum to complete this information.

Thank you, Does it mean if someone who doesnt have EIN nor files for tax treaty, will have to cut his revenue by 60%?! and yes i am looking for a tax professional but it takes so much time to find one who knows about W8BEN for itunes connect because i have asked few of them but they weren't sure. In case i wanted to ask it directly from apple, which email is the best for asking questions about these things in itunes conenct? I appreciate it.

I would keep looking for a tax professional who can give you a definitive answer. If there is a local user group with some established developers who have published in the App Store, that would be a good place to start.


Apple always keeps 30% of sales. The additional 30% is a tax regulation for some circumstances. So yes, it could add up to 30% + 30% or 30% of the remaining 70% or whatever. I don't know. I do know that tax penalties when you get things like this wrong could add up to more.


You need advice from a tax professional if you want definitive answers to these questions. Keep looking for one.
