Background:

Implementing Gambling App but yet to obtain approval


Clarification:

  • In Section 5.3.4 Apps that offer real money gaming (e.g. sports betting, poker, casino games, horse racing) or lotteries must have necessary licensing and permissions in the locations where the App is used, must be geo-restricted to those locations, and must be free on the App Store.
  • But the gambling app to be implemented will face critical timing issue if we were to wait until license has been issue.
  • As such, is it possible to submit Gambling App for review for now and set release date in the future as and when license is obtained.
  • This will minimize the risk and allow us sufficient time to appeal/resolve the issue.


Since release date is set in the future, the application will be activated and shown in store only when license is issued.

'must have' means just that.


You can't expect Apple to take your word for what may or may not happen later. I'd be very surprised if they let you anywhere near the store without meeting the requirements in the guidelines.

There is ambiguity in the timing of the required license. Clearly it must come before launch. Arguably it must come before app approval. Perhaps your question should be - does Apple check to be sure the license has been obtained before app launch or do they leave that to the developer? For 100% transparency include a note for App Review indicating that licensing has been applied for and launch will occur only after it is granted.
