Is it okay commercially distribute an app via TestFlight?

Hello everyone, so i came across this app called igo location tracker on TestFlight: https://testflight.apple.com/join/NssXk9W9

This app can spoof gps location on iOS devices. My guess is they did not get approval to list the app on the App Store, so they published it on the TestFlight. The thing is they did not list the app on test flight to get user feedbacks, they are making money out of it. If you want to use the app to change your gps location, then you need to buy their subscription plan which varies from $19.99 to $79.99.

They are promoting the app on the internet and making the users to download and install in on their ios device from Testflight. Is it alright to sell/promote your app using TestFlight? Apple wouldn't do anything about it?
