Copyright Issues for Pop-Culture Apps

Hi,


Would anyone be able to clarify the copyright laws for applications regarding pop-culture? (eg: Musician Fan Pages, Trivia Quizes, Celebrity Fact-of-the-Day, etc). I see many on the app store, unfortunately mine was rejected due to copyright infringement, but very few details were presented. My app is a lyrics trivia app where the user is presented with small snippets of lyrics (of a certain singer/songwriter) and have to guess the correct song.


Is there anyway to make this app approved for the App Store?

Not sure I understand the question...


Legal questions are best put to your attorney. Details on your responsibility in the store should be covered in your Developer Account agreement, but basically, the dev is expected to be able to provide proof of rights to use should Apple ask.


If you have those rights, gather your proof and provide it to Apple while filing an appeal. Same if you believe the rejection is in error...file an appeal.

You want to claim that your use of snippets of copyrighted works are 'fair use'. Determining whether or not something falls within 'fair use' is complicated. You can start here:

There are two issues - whether you fall under fair use and whether the App Store perceives you fall under fair use. The first is a matter for the courts to decide if and when you get sued by the copyright holders. Fortunately, that is unlikely but is a risk you will be taking. The second is your immediate problem. One way to handle the perception of the App Store is to assert that your use constitutes what is called "fair use" by the US Copyright Office as described in the link above until such time as the courts determine otherwise. Then wait to see if App Review asserts differently.
