Breach of clause 4.1 App store review guideline
According to App Store Review Guidelines 4.1 copycat, developer cannot breach this clause. Buy unfortunately there are hundreds of developer that breach the clause including the big publisher like ketchapp and apple never took an action against it. one example is Ballz copy of swipe break breaker, not only that they even plagerized the phrase the champion of time killer. But it seems there are few clause that indie developer can breach it too if big publishers are breaching it.

>That is now being dictated by the Appstore, which I feel is very unfair toward developers who are not spamming or cloning games, but rather, providing a specific audience with the exact app they are looking for. After all, marketing is 100% of what makes an app successful these days. The gold rush days of the appstore are over, so if you don't have marketing, you don't have a specific target market in mind, then you don't have any reason to release an app in the first place. And that is what scares us the most as indie developers.How is this not spamming or cloning? Apple is going in right direction - App Store is flooded with copycat apps.

Hello Tomato,I would tell you to use the Report a concern button, but it doesn't work. This developer only has a couple dozen copycat apps. I checked some of the reviews. Mostly they look legitimate. Many were one-star but obviously wrong, blaming the developer because the user didn't know how to use the LaunchPad. That one reviewer only has 3 review and they are years apart.I hate to tell you this, but in the context of the Mac App Store, this developer is really top-tier - the cream of the crop. Most are much, much worse.

4.1 Copycat when use content from an API
Hi,I've build an app who uses content from Wikia Fandom API.The app display characters and episodes from Rick and Morty.Of course I do not own the rights from Rick and Morty characters, but I can have the rights to use content who comes from Wikia API.My App is free of charge and do note make any money of it.How can my app be rejected for copycat reason ?It's like IMDB was rejected because it's displaying movie poster and don't own the right of the show ?Here the content of the rejection reason :Your app or its metadata appears to contain misleading content.Specifically, your app includes content that resembles “Rick and Morty” without the necessary authorization. It would be appropriate to remove all resembling content from the metadata.What do you think about it ? How can can I change that ?To be clear, my app screenshots, are in app screenshot displaying Rick and Morty characters.

Completely agree with you. We have an online ordering system for restaurants. We won 2 innovation startup awards. We have 100% native Obj-C and Java code. We use each OSs native components to make the apps look and feel native for each device. We customize ieach app for each restaurant to have it's own feeling and connect it to several 3rd party systems they are using like fleet management systems, POS etc. and we are now releasing apps only for google play. Our newest clients have a crippled product, even though we try to make bigger and bigger changes to each app in order to make it even more clear that they are not copycats, but apps that only share a minimum, logical amount of UX. Since we were always trying to be in par with HIGs and ASRGs we perfected our apps to have the best flow and usability for our users and we try to keep that in all our apps but Apple has different opinion on that, so it rejects every change we make. Good job Apple, thank you.

Reply to Similar app name with non-competitor, will review be successful?
Even if we knew what X is supposed to indicate, no one here can predict how App Review will react.My opinion is that 'similar' is a risk.See Section 4, Design,in the ASRGs:4.1 Copycats Come up with your own ideas. We know you have them, so make yours come to life. Don’t simply copy the latest popular app on the App Store, or make some minor changes to another app’s name or UI and pass it off as your own. In addition to risking an intellectual property infringement claim, it makes the App Store harder to navigate and just isn’t fair to your fellow developers.But if you haven't staged your app yet, for all you know, X is already taken...just because you don't see it in the store, doesn't mean it's up for grabs.

Can we get approval for differently skinned apps
We have an interesting use case request from a client. They have about 300 partners that use their data to help people get discounted medications if they don't have insurance coverage. They want the partners that are interested to be able to have their own app that uses the same data but provides the discounts through the partners branded drug card. I doubt anywhere near 300 partners would sign on to have their own app. But before we can tell the client we would be able to provide them with different versions and maintain them, I want to make sure the app store will approve the apps. When I look at the guidelines it doesn't seem that it would violate them. The copycat section seems the most relevant. Can anyone offer any guidance or informed opinions about this? Dan

Stange App Rejection Reason: The seller and company names associated with your app do not reflect the App name
Our App, TaxFreeway 2017, is rejected by App Review with following reason:The seller and company names associated with your app do not reflect the name “TaxFreeway 2017” in the app or its metadata, as required by Guideline 5.2.1 of the App Store Review Guidelines.Next StepsYour app must be published under a seller name and company name that reflects the TaxFreeway 2017 name. If you have developed this app on behalf of a client, please advise your client to add you to the development team of their Apple Developer account....Based on our understanding, the message above indicates that our App must be named by our company name.Our product searial, TaxFreeway, is a Canadian T1 tax preparation software/App full owner by our company Entorpy Technology Ltd. Our have the same product serial one Windows, Mac and iPad since 2003. Plus, our iPad App serial (named the same as TaxFreeway) has been on sale on Apple App Store since 2009 as TaxFreeway 2009, TaxFreeway 2010, TaxFreeway 2011 etc. for last a few years and never

iOS App Store app copycats during delayed release/beta testing
I have an app approved by Apple waiting to be released while I collect more advance users through my landing page. I am worried about someone making a copycat app with the exact name and getting approved by Apple. For example, let's say my app is named Liquid - Dynamic Workout (the real name is slightly more unique). Could someone release an app before my set release date that is a copycat titled Liquid Workout? Additionally, for example, the domain liquidworkout.com is being squatted on, so I had to register liquidworkouts.com.Basically, if my app is already approved by Apple for app store release, and is on TestFlight, can someone still submit an app with a similar name, similar logo, and the same function? Exact names can't be used in the same country.Who knows how app review will react to a same-only-different name, which may be only one factor during review.I woudn't count on every variation of your app you can think of running afoul/being spotted/actionable during review.

Apple will allow an app with a slightly different name and similar function. The fight is between you and that “copycat”. Apple will facilitate a communication between them and you but you need to assert either contract or ip law to get them to stop. Do you have a trademark on the name that is damaged by their use of a similar name?; Do you have any patents on inventions necessary for the app to function?; Did they agree to not copy the idea before you included them in TestFlight? If not, your only hope is that they don’t and you can outperform or outmarket them.

Design: Copycats ? but i have permission from the representative?

App rejection - Design Copycats - Proving that the identity of app developer is same as the brand of the app
Our app has been rejected for the following reason -Guideline 4.1 - Design - CopycatsYour app or its metadata appears to contain potentially misleading content. Specifically, your app includes content that resembles XYZ without the necessary authorization.Please demonstrate your relationship with any third-party brand owners represented in your app.Since the organization that operates this apple developer account also owns the brand and website of XYZ, please let me know what documentation/proof is needed to prove to Apple that the app actually belongs to us. Also how/where must this information be posted to apple.Thanks!
